DELIVERY POLICY
1. Introduction
Radiant Real Estate is committed to ensuring a smooth and transparent process for property handovers and service deliveries. This Delivery Policy outlines the timelines and conditions under which property transactions and related services are completed, in accordance with Federal Law No. 5 of 2022 (New UAE Real Estate Law), Law No. 3 of 2015 (Abu Dhabi Real Estate Law), and the UAE Civil Code.
By engaging with Radiant Real Estate, customers acknowledge and agree to the terms set forth in this Delivery Policy.
2. Property Handover Policy
- Property handovers are conducted in accordance with the Department of Municipalities and Transport (DMT) regulations and Abu Dhabi Real Estate Centre (ADREC) guidelines.
- In compliance with Federal Law No. 5 of 2022, developers must register all off-plan sales in the Initial Property Register within 30 working days of contract signing.
- As per Law No. 3 of 2015, Radiant Real Estate is entitled to a grace period of up to 12 months beyond the initially estimated handover date stated in the Sale and Purchase Agreement (SPA).
- Handover is contingent upon:
- Issuance of Building Completion Certificate from Abu Dhabi Municipality
- Civil Defense approval and issuance of safety certificates
- Completion of all snagging processes and quality assurance checks
- Full compliance with all SPA terms, including complete payment of purchase price and associated fees
- As required by ADREC, customers will receive formal written notification regarding property readiness for handover at least 30 days prior to the scheduled handover date.
3. Leasing Agreement Policy
- All lease agreements comply with Law No. 20 of 2006 concerning the leasing of properties in Abu Dhabi and its amendments.
- All lease contracts must be registered with Tawtheeq, the official Abu Dhabi tenancy contract registration system administered by the Department of Municipalities and Transport.
- Lease registration fees (currently 3% of annual rent) must be paid prior to occupancy.
- Security deposits are held in accordance with Abu Dhabi rental law (typically 5% of annual rent for residential properties).
- Rent increase regulations follow the DMT’s rent index and caps as per Abu Dhabi Executive Council Resolution No. 14 of 2022.
4. Property Management Services
- Property management services adhere to the ADREC’s Service Level Agreements framework.
- Emergency maintenance requests are addressed within 24 hours as per ADREC guidelines.
- Routine maintenance follows schedule protocols established by Abu Dhabi’s Department of Municipalities and Transport.
- Service charges are calculated and implemented in accordance with Law No. 3 of 2015 (Abu Dhabi Real Estate Law) and Ministerial Resolution No. 1320 of 2022.
- Owners Associations are established and operated as per Law No. 6 of 2019 concerning ownership of jointly owned properties in Abu Dhabi.
5. Payment Confirmation & Service Processing
- For off-plan properties, payment schedules comply with the ADREC escrow account regulations under Law No. 3 of 2015.
- Escrow accounts are maintained with approved banks as per the Department of Municipalities and Transport requirements.
- Property title deed (Mulkiya) issuance follows completion of all payments and property registration requirements as stipulated in Abu Dhabi Law No. 3 of 2015.
- Transfer fees (currently 2% of property value) and registration fees must be paid to the Land Department before final handover.
6. Compliance & Regulatory Considerations
All property handovers, leasing processes, and management services adhere to:
- Federal Law No. 5 of 2022 regarding the regulation of real estate sector
- Law No. 3 of 2015 regulating the real estate sector in Abu Dhabi
- Law No. 19 of 2005 concerning real estate property ownership
- UAE Civil Code provisions relating to property transactions
- Executive Council of Abu Dhabi Resolutions and Circulars relating to real estate
- Department of Municipalities and Transport regulations and circulars
- Abu Dhabi Civil Defense safety regulations and technical requirements
7. Dispute Resolution
- As per Federal Law No. 5 of 2022, property-related disputes are first addressed through mediation by ADREC.
- If mediation is unsuccessful, disputes shall be resolved through the Abu Dhabi Rental Disputes Settlement Center for leasing matters or the competent courts for sales and other matters.
- Arbitration proceedings, if agreed upon in contracts, shall follow UAE Federal Arbitration Law No. 6 of 2018.
8. Changes to This Policy
Radiant Real Estate reserves the right to update this Delivery Policy in accordance with changes in UAE and Abu Dhabi real estate regulations or company policies. Any updates will be communicated through our website or official customer notifications.
