1. Introduction

Radiant Real Estate, based in Abu Dhabi, UAE, was established in 2007 by visionary leaders Ahmed Amer Omar and Naser Amer Omar. Under the leadership of our CEO, Khaldoun Mohamed Saleh, Radiant Real Estate has become a trusted name in the industry. We specialize in property sales, leasing, off-plan property sales, and property management, offering innovative, sustainable, and luxurious developments that enhance the quality of life for residents in Abu Dhabi.

By accessing and using the website www.radiantrealestate.ae and engaging in any transactions with Radiant Real Estate, you acknowledge that you have read, understood, and agree to comply with these Terms & Conditions.

2. Scope of Services

Radiant Real Estate operates solely in the UAE, providing the following services:

  • Property Sales (Residential and Commercial)
  • Property Leasing
  • Off-plan Property Sales
  • Property Management Services

Our services are available only to individuals who hold a valid UAE residency and meet the eligibility criteria as per UAE Federal Laws and Abu Dhabi real estate regulations.

3. User Responsibilities

Clients engaging with Radiant Real Estate must:

  • Comply with UAE Federal Law No. 5 of 2022 and Abu Dhabi Law No. 3 of 2015 governing real estate transactions
  • Adhere to the terms outlined in the Sale and Purchase Agreement (SPA)
  • Provide accurate and complete information during all transactions
  • Complete Know Your Customer (KYC) verification as required by UAE Anti-Money Laundering laws and regulations
  • Present valid identification documents, including Emirates ID or passport with valid residency visa
  • Disclose all relevant information that might affect property transactions
  • Comply with payment schedules as stipulated in the SPA
  • Adhere to property usage guidelines as specified by Abu Dhabi Municipality

4. Payments & Transactions

Radiant Real Estate accepts payments through the following methods:

  • Credit and Debit Cards
  • Bank Transfers to designated company accounts
  • Manager’s Cheques
  • Post-dated Cheques (for installment plans)
  • POS Machines at our offices
  • Cash (subject to UAE financial regulations regarding cash transaction limits)

Deposit requirements vary according to the property’s payment plan and are governed by the escrow account regulations as per Abu Dhabi Law No. 3 of 2015. All payments are subject to the conditions outlined in the SPA.

For off-plan properties, all payments are directed to Abu Dhabi Real Estate Centre (ADREC) approved escrow accounts in accordance with regulatory requirements.

5. Booking & Reservation Policies

Customers can reserve properties through our website or in person at our offices, provided they adhere to UAE and Abu Dhabi Real Estate Laws. Online reservations require:

  • Completion of a reservation form
  • Payment of a reservation fee as specified (via secure payment gateway)
  • Acceptance of the terms and conditions

For property purchases, holding deposits are transferred to an ADREC-approved escrow account. The validity period of holding deposits is typically 7 days, during which the client must proceed with the SPA signing, unless otherwise specified in writing.

6. Refund & Cancellation Policy

Refund and cancellation policies are governed by:

  • Terms specified in the Sale and Purchase Agreement (SPA)
  • Abu Dhabi Law No. 3 of 2015 regulating real estate transactions
  • Radiant Real Estate’s official Refund & Cancellation Policy

7. Intellectual Property Rights

All content on the Radiant Real Estate website, including but not limited to text, graphics, logos, images, audio clips, digital downloads, and software, is the property of Radiant Real Estate or its content suppliers and is protected by UAE and international copyright laws.

The compilation of all content on this website is the exclusive property of Radiant Real Estate and is protected by UAE intellectual property laws and Digital Millennium Copyright Act (DMCA). Unauthorized use, reproduction, or distribution of any content from Radiant Real Estate’s website is strictly prohibited and may result in legal action.

8. Data Privacy & Security

Radiant Real Estate collects only essential marketing and sales-related customer information, including name, contact details, and property preferences. We implement industry-standard security measures to protect customer data.

All payment-related transactions are handled by UAE Central Bank-verified payment gateways, ensuring compliance with Payment Card Industry Data Security Standards (PCI DSS). Radiant Real Estate does not store sensitive payment information on our servers.

Customer data is not shared with third parties, except when:

  • Required by UAE regulatory authorities
  • Necessary for transaction completion (e.g., property registration, escrow services)
  • Client provides explicit consent for specific services

9. Liability & Disclaimers

Radiant Real Estate makes every effort to ensure accuracy in all property information, pricing, and availability. However:

  • We do not guarantee that the information provided will always reflect real-time changes
  • Property specifications, plans, dimensions, and features may be subject to variation
  • Images and visual representations are for illustrative purposes only and may differ from the actual property

Radiant Real Estate shall not be liable for:

  • Any inaccuracies in the information provided on our website or marketing materials
  • Changes in property pricing, availability, or financing terms
  • External factors affecting property transactions, including economic conditions or changes in UAE real estate laws

10. Dispute Resolution

Any disputes arising from transactions with Radiant Real Estate shall be resolved as follows:

  • Initial attempt at amicable resolution through direct communication
  • Mediation through Abu Dhabi Real Estate Centre (ADREC) as per UAE Federal Law No. 5 of 2022
  • Arbitration proceedings in accordance with UAE Federal Arbitration Law No. 6 of 2018, if specified in the contract
  • Litigation through competent courts in Abu Dhabi

The governing laws for all real estate transactions and agreements shall be:

  • UAE Federal Law No. 5 of 2022 regarding real estate sector regulation
  • Abu Dhabi Law No. 3 of 2015 regulating the real estate sector
  • UAE Civil Code provisions relating to property transactions
  • Any other applicable UAE federal or Abu Dhabi laws and regulations

11. Changes to Terms & Conditions

Radiant Real Estate reserves the right to modify these Terms & Conditions at any time without prior notice. Changes will become effective immediately upon posting on the website. Continued use of our website or services constitutes acceptance of the updated terms.
